Personal Data Protection Notice

This Notice has been prepared under Personal Data Protection Law No. 6698 ("KVKK") to set out how personal data obtained through the website of MODIFUSE TEKNOLOJİ SANAYİ VE TİCARET ANONİM ŞİRKETİ is processed.

It applies to all users who visit the site and who contact us through it.

Under the KVKK your personal data is processed by MODIFUSE TEKNOLOJİ SANAYİ VE TİCARET ANONİM ŞİRKETİ in its capacity as data controller.

If you send a quote request or contact us, the following categories may be processed, limited and proportionate to the purpose:

• Identity data: first name and surname
• Contact data: email address, telephone number, company name and address
• Request content: the technical files you send, quantity, material and finishing preferences, and your notes
• Transaction security data: the date and time the request was submitted

Your personal data is processed in line with Article 5 of the KVKK for the following purposes:

• Evaluating your quote request and issuing a quote to you
• Planning and running the production process and completing delivery
• Communicating with you about your request and providing technical guidance
• Performing contractual obligations and pursuing legal claims
• Meeting retention and disclosure obligations arising from legislation

Your personal data is collected electronically, based on your own declaration, through the quote request form and contact channels on the site.

Processing rests on the following legal grounds set out in Article 5 of the KVKK:

• Direct relation to the conclusion or performance of a contract (Art. 5/2-c)
• Necessity for the data controller to fulfil a legal obligation (Art. 5/2-ç)
• Necessity for the legitimate interests of the data controller, provided this does not harm the fundamental rights and freedoms of the data subject (Art. 5/2-f)

Processing outside these grounds is carried out only where you have given explicit consent.

Your personal data may be transferred to the following parties, only to the extent the production relationship requires and limited to that purpose:

• Authorised public institutions and judicial authorities, where required by legislation
• Courier and logistics providers engaged to carry out delivery
• Accountancy and legal advisers, in meeting financial and legal obligations

The technical files you send are not shared with third parties outside the production purpose, and production is not delegated to a third-party supplier.

Your personal data is retained for as long as the purpose of processing requires and for the minimum retention periods prescribed by legislation.

Your technical files are kept for the duration of the job and for any revision requests. On your request they are destroyed after delivery, and the destruction is confirmed to you in writing.

Once the retention period ends, your data is deleted, destroyed or anonymised.

Under Article 11 of the KVKK you have the following rights in respect of your personal data:

• To learn whether your personal data is being processed and, if so, to request information about it
• To learn the purpose of processing and whether the data is used in line with that purpose
• To know the third parties to whom the data is transferred, in Turkey or abroad
• To request rectification where the data is incomplete or inaccurate
• To request erasure or destruction within the conditions set out in the Law
• To request that rectification, erasure and destruction be notified to the third parties to whom the data was transferred
• To object to an adverse outcome arising from analysis solely by automated systems
• To claim compensation where you suffer loss due to unlawful processing

Applications, together with information verifying your identity, can be sent to the contact details at the end of this page. Your application is concluded within thirty days at the latest, depending on its nature. Applications that do not include identity verification or that do not follow the proper procedure may not be assessed.
